Proposals to replace Deprivation of Liberty Safeguards

Community Care reports on the Mental Capacity (Amendment) Bill which will see Deprivation of Liberty Safeguards replaced by Liberty Protection Safeguards (LPS). The article highlights some concerns about the amendment bill, such as that arrangements will no longer be based on the best interests of the individual but will instead be “necessary and proportionate”. Sarah Lambert, Head of Policy and Public Affairs at the National Autistic Society, suggests that the amendments no longer puts peoples preferences or wishes at the centre of the decision-making process.
