Definitions

Network Autism refers to this website (www.networkautism.org.uk) and is managed and overseen by the National Autistic Society.

  • ‘Network Autism Community Member’ or ‘Community Member’ refers to any person or persons registered on Network Autism and viewing or interacting with this site.
  • ‘Network Autism Team’ refers to the Network Autism manager, moderators and the internal Network Autism management team.
  • ‘Content’ refers to any text, video, photograph or other image presented on this site by either the NAS or Network Autism Community Members.
  • ‘Post’ refers to any content that you (Community Members) or the Network Autism Team uploads to the site.
  • ‘NAS’ means The National Autistic Society and Autism UK Ltd, and includes any person or organisation involved in any part of the design, development, response-handling, marketing, promotion or other similar aspects of this site.

All content submitted by Community Members, views, opinions and information, whether publicly posted or privately sent are those of the individual and are not the views, policy or advice of the NAS. This includes content submitted by NAS staff members when they are participating as individuals in a non-official capacity.

There are a number of links from this website to sites maintained by other groups. These links are provided purely to assist you and in good faith. The Network Autism Team produces news articles and Posts on the site. This content is provided purely to facilitate debate and to assist you in good faith. This content does not imply that the NAS endorses or supports the subject of this content nor does the absence imply that the NAS does not support other practises, resources or groups.

The NAS cannot be held responsible for any damage or loss caused by any inaccuracy in the materials on this site, or in linked sites/pages.

Limitation of liability

You agree, to the maximum extent allowed by law, to indemnify the NAS and any affiliates from and against any and all liabilities, expenses (including legal fees) and damages arising out of claims resulting from your use of the website, including, without limitation, any claims alleging facts that if true would constitute a breach by you of these terms. If you are dissatisfied with any of the website material or with any of these terms, your sole remedy is to discontinue using the website.
The NAS shall not be liable for any claims, losses, injuries, penalties, damages, costs or expenses arising from the use of, or inability to use, the website or its content, or from any action taken or omitted.
Notice

  • Where a breach of these terms and conditions occurs, the NAS reserves the right to take such action as it sees fit.
  • This agreement shall be governed in accordance with English law and you submit to the sole jurisdiction of the English courts.

Privacy and Data Protection

Those who create and become administrators of private groups will have, if provided by the individual community member, access to their email address. This email address must only be used to verify the appropriateness of the request to join the group and for no other purpose.

Terms and conditions - Content

 We would love to share your material ("Your Content") on Network Autism. By sending it to us, you are agreeing that the NAS can modify Your Content to make it suitable for the website. If it is accepted by the Network Autism Manager, the NAS will reproduce Your Content on Network Autism so that all registered members of Network Autism can have access to it.

About content

1. The majority of the information, case studies, research summaries, resources, videos, data, text, photographs, graphics or any other material on Network Autism is generated by Network Autism members ("Members’ Content"). Other material ("Our Content") is generated by the National Autistic Society (NAS).
2. When you use Network Autism you will have access to Members’ Content and Our Content on the same terms and conditions as these, which aim to support collaboration and the free sharing of knowledge and information.
3. By making Your Content available on Network Autism you grant the NAS a royalty-free licence to distribute, reproduce, modify, adapt, and display Your Content on Network Autism and you grant an irrevocable licence for Network Autism Members, including the NAS, to use Your Content free of charge and without any restrictions, provided that the user acknowledges the source.
4. The NAS has complete discretion whether to accept or reject any Content submitted and is not obliged to provide a reason for rejection.
5. You can ask the Network Autism Manager to remove Your Content from Network Autism at any time but you recognise that Your Content may continue to be used by Network Autism members (including the NAS) pursuant to these Terms and Conditions.

Acceptable and unacceptable content

6. Your Content must not infringe any copyright, registered trademarks, rights of privacy, rights of confidentiality, publicity or other intellectual property or other rights of any other person or organisation and you warrant that Your Content contains no such infringement to your knowledge having taken reasonable care to avoid any such infringement.
7. Content must not contain any information about any person who is 15 years old or younger, which could be used to identify them unless you have their consent (or the consent of a guardian or family member) in writing.
8. Content must not contain any information about any vulnerable child or adult, which could be used to identify them unless you have their consent (or the consent of a guardian or family member in the case of minors or adults unable to give consent in their own right), such consent being in writing.

Liability and responsibility

9. You are solely responsible for the accuracy and legality of Your Content.
10. Your Content is displayed on Network Autism entirely at your risk.
11. Please keep a copy of all material you submit in accordance with your organisation’s or employer’s policies and processes.
12. If Your Content contains names, photographs, videos or other personal information about individuals then you must make sure that permission has been sought by the individual in question or their legal spokesperson for the material to be shared on Network Autism and in submitting Your Content you warrant that such explicit consent has been obtained.
13. It is your sole responsibility to ensure that Your Content complies with your organisation’s or employer’s policies and processes.
14. The NAS will not be responsible as author, editor or publisher for Your Content.
15. Views and opinions expressed in Your Material are yours alone and their being posted on the Network Autism website does not make them the views, opinions, policy or advice of the NAS. This includes material submitted by NAS staff members when they are participating as individuals in a personal capacity, which is to be assumed unless it is specifically stated that the NAS staff member is acting on behalf of the NAS.

Intellectual property

16. Your Content will remain your property. The NAS does not claim ownership of Your Content (but note conditions 3 and 5 above and 17 below).
17. You retain the ownership rights for Your Content and grant the NAS a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, trade marks, design rights, database rights and all other intellectual property rights you or any third party or parties has or have in Your Content, in any media known now or in the future.
18. All copyright, publicity, trade marks, design rights, database rights and all other intellectual property rights in or relating to Our Content on Network Autism belong to the NAS and those rights in the Content of other Network Autism Members belong to those other Members but in all cases you have a similar licence to use the material pursuant to these terms and conditions.

 

Terms and conditions - Posting

We encourage you as a Network Autism Community Member to get involved in Network Autism by sharing your thoughts, opinions and information with others in the discussion forums and groups on Network Autism, a service provided by The National Autistic Society (“NAS”).  You can post comments in the discussion forums and upload content (documents, videos, links etc) in the groups. Please read the full terms and conditions for posting in the discussion forums and groups below.  By posting on Network Autism you are agreeing to adhere to the full terms and conditions of Network Autism.

About posts

1. The majority of the posts on Network Autism are generated by you (Your Posts), other Network Autism Community Members (“Members’ Posts”). Other Posts (“Our Posts”) will be generated by the Network Autism manager or others from Network Autism Team.
2. Posts refers to content on both the discussion forum and group function of Network Autism.
3. When you use Network Autism you will have access to all Posts on the same terms and conditions as these, which aim to support collaboration and the free sharing of knowledge and information.
4. By making Your Posts available on Network Autism you grant the NAS a royalty-free licence to distribute, reproduce, modify, adapt, and display Your Posts on Network Autism and you grant an irrevocable licence for the NAS, including Network Autism, to use Posts free of charge and without any restrictions, provided that the user acknowledges the source.
5. The NAS has complete discretion as to whether to remove Posts and is not obliged to provide a reason for removal.
6. You can ask the Network Autism Manager to remove Your Posts from Network Autism at any time but you recognise that Your Posts may continue to be used by Network Autism Community Members (including the NAS) pursuant to these Terms and Conditions.

9. Your Posts must not contain any information about any vulnerable adult,  which could be used to identify them unless you have their explicit consent in writing (or if they are unable to give informed consent, the written consent of a person authorised to do so under the Mental Capacity Act or by the Court of Protection.
10. Your Posts must not contain personal contact details of any individuals without their explicit consent.
11. Your Posts must not be obscene, defamatory or libelous, vulgar, sexually orientated, hateful, threatening or in violation of any laws.
12. Your Posts must not be sexist, homophobic, racist, intolerant of religious beliefs, or otherwise discriminatory. This includes links to pornographic or hate sites.
13. You may only post advertisements or promotions of specific products or services within the ‘Upcoming events’ or 'Notices' discussion forums. Any Post containing an advertisement or promotion posted other than within this forum will be deleted or migrated to these forums by the Network Autism Team.
14. Links submitted in Posts must not link to web pages or services that break UK law or conflict directly or in spirit with the terms and conditions of use of the online community.
15. Posts that are in public discussion forums or groups must be written in English.
16. Posts that contain promotion of dangerous therapies and approaches (dangerous as defined by Research Autism – www.researchautism.net) will be removed. Repeated promotion of such therapies and approaches will result in permanent exclusion from Network Autism.
17. Posts containing swearing or offensive language will be removed. Repeated use of such language will result in permanent exclusion from Network Autism

18. Any Posts breaching any of these terms and conditions are subject to deletion at the sole discretion of Network Autism and the Community Member may be permanently excluded from Network Autism.

Accuracy and use of posts

19. We do not warrant the accuracy, completeness, integrity or quality of any of Posts on Network Autism.
20. Information supplied in Posts may be out of date and we make no commitment to update or remove the information. 
21. Posts cannot be regarded as constituting advice or recommendations (professional or otherwise) from The National Autistic Society and should not be relied on without taking independent advice. You are solely responsible for any decisions you take based on information in Posts.
22. Where Network Autism contains links to websites provided by third parties, these links are provided for your information only. We have no control over the availability or content of such other websites, nor for any products or services available from them. Any such link should not be seen as an endorsement of such websites, or any products or services contained on them.
23. Use of other websites via links from Network Autism may be subject to additional terms and conditions imposed by the owners of those websites. Your dealings with such third parties are between you and the third party, and we accept no liability as a result of you accessing such websites or entering into contractual arrangements with the operator in question.

Monitoring and moderating posts

24. We reserve the right, but have no obligation, to monitor Posts on Network Autism.
25. Moderation of Posts will be judged on a case by case basis. Inappropriate Posts (deemed as those that convene any of Network Autism’s terms and conditions) will be edited or removed and repeated posting of inappropriate content may result in the user being permanently excluded from Network Autism.
26. We reserve the right to promptly, without notice or the giving of reasons, to reject, remove, or edit any Posts on Network Autism.
27. If you encounter any Posts or behaviour which you believe to be unacceptable you should report it to us by using the Feedback link on Network Autism. We will then review the content or behaviour and decide whether it complies with the Terms and Conditions and we will deal with it at our discretion.
28. Where appropriate and possible we will inform you of any decision to remove Posts. This is not an obligation.
29. The setting up of groups will require permission from the Autism Network Team. Permission is required to avoid duplication of groups and inappropriate groups.
30. We reserve the right, but have no obligation, to monitor groups on Network Autism.
31. Where appropriate and possible we will inform you of any decision not to grant permission for a group. This is not an obligation.

35. It is your sole responsibility where relevant to ensure that Posts comply with your organisation’s or employer’s policies and processes including their social media policies and processes.
36. The NAS will not be responsible as author, editor or publisher for Posts.
37. Views and opinions expressed in Posts are yours alone and their being posted on the Network Autism website does not make them the views, opinions, policy or advice of the NAS. This includes material submitted by NAS staff Community Members when they are participating as individuals in a personal capacity, which is to be assumed unless it is specifically stated that the NAS staff Community Member is acting on behalf of the NAS.

Intellectual property

38. Any content posted within the groups on Network Autism, that is your legal property will need to adhere to the Network Autism Content T&Cs – Intellectual property.
39. It is your sole responsibility to ensure that you have all copyright, publicity, trade marks, design rights, database rights and all other intellectual property rights of material in Posts. The NAS takes no responsibility for any content in Posts. 
40. You retain the ownership rights for Posts but grant the NAS a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, trade mark, design, database and all other intellectual property rights you or any third party or parties has or have in Posts, in any media known now or in the future.
